Implementation Regulations of the New Archives Law published, effective March 1! Key interpretations as follows!

On December 29, 2023, Premier Li Qiang of the State Council presided over an executive meeting of the State Council, which deliberated and passed the "Implementing Regulations of the Archives Law of the People's Republic of China (Draft)."

This newly revised Implementation Regulations of the Archives Law of the People's Republic of China (Draft) is also the first major revision since the comprehensive revision of the Measures for the Implementation of the Archives Law of the People's Republic of China in 2017.

On January 4, 2024, China Archives News published an article titled "Supporting High-Quality Economic and Social Development with High-Quality Archives Work", emphasizing that in order to continuously expand the application scope of electronic invoices, the first priority is to continue to do a good job in the electronic reimbursement, booking and archiving of electronic invoices, fully promote ecological civilization construction, and build a green and low-carbon development highland.

Previously, building on the pilot of electronic invoices, the National Archives Administration, together with finance, commerce, taxation, and other departments, formulated the Guidelines for Full-Process Electronic Management of Electronic Invoices, systematically designing the processes and methods for electronic reimbursement, booking, and archiving of electronic invoices.

On January 25, 2024, the "Implementation Regulations of the Archives Law of the People's Republic of China" (hereinafter referred to as the "Implementation Regulations") was officially issued and came into effect on March 1, 2024. This revision of the "Measures for the Implementation of the Archives Law of the People's Republic of China", renamed as the "Implementation Regulations", aims to implement the provisions of the newly revised Archives Law, further optimize the archives management system and mechanisms, improve institutional measures for the complete collection, safe custody and effective use of archive resources, enhance the scientific and standardized level of archives work, scientifically and precisely guarantee the effective implementation of the Archives Law, and provide strong legal protection for the innovative development of archives undertakings.

The Implementing Regulations consist of 8 chapters and 52 articles, and focus on the following content:

As an important administrative regulation supporting the Archives Law, the Implementation Regulations, while adhering to the principles of unified leadership and tiered management, continuously improve the archives work system and mechanism of Party committee and government leadership, archives departments taking overall responsibility, and all parties participating jointly, and implement the archives work responsibility system.

The digital transformation of archive work is an inevitable choice and the only path to adapt to the Digital China development strategy, improve archive governance effectiveness, and achieve high-quality development of the archive cause. The Implementation Regulations add a special chapter on "Archive Informatization Construction" and further improve the provisions on archive informatization construction on the basis of the Archives Law. First, it requires organs, mass organizations, and state-owned enterprise and public institution units to incorporate archive informatization construction into their own informatization construction plans, strengthen the construction of archiving functions in office automation systems and business systems, and interconnect them with electronic archive management information systems to achieve full-process management of electronic archives. Second, it clarifies the three conditions that electronic archives should meet, and improves related measures for the transfer, receipt and preservation of electronic archives. Third, it supplements archive security management provisions in the digital environment, and puts forward requirements for off-site backup preservation of important electronic archives, construction of disaster backup systems, digitization of traditional carrier archives, and construction of digital archives (rooms). Fourth, it stipulates the responsible entities for promoting the sharing and utilization of archive digital resources.

The Implementing Regulations add provisions on archives informatization in step with the times, which will strongly advance the digital transformation of archives work.
